Practice involves all major federal and state environmental statutes, including air, water, solid/hazardous waste, and radioactive material.
Representative Experience
- Defense of fraud and negligence claims brought by property buyer against energy company for contamination of real property, business losses and personal injury.
- Defense of fertilizer and agricultural products manufacturer against RCRA enforcement action brought by U.S. EPA.
- Environmental due diligence, asset purchase agreement structuring and drafting and environmental counseling for buyer of petrochemical marine terminal.
- Secured non-applicability determination from Texas Commission on Environmental Quality in favor of petrochemical manufacturer regarding air emissions control requirements.
- Defense of homebuilder against U.S. EPA enforcement action for alleged violations of federal stormwater rules.
- Prosecuted successful appeals of Texas Commission on Environmental Quality compliance history rating determinations for petroleum products terminal and petrochemical manufacturer.
- Declaratory judgment action and petition for review of Houston/ Galveston Area State Implementation Plan (HGA SIP).
