Real Estate Companies Pay Fines for Violating EPA’s Residential Lead Regulations

Two Hawaii real estate companies, Century 21 Homefinders of Hawaii in Hilo, and Coldwell Banker Island Properties of Kahului, Maui, agreed to pay a total of over $26,000 in fines for violating EPA’s rules requiring disclosures relating to lead paint for homes built before 1978. 

Lead Paint Disclosure Required for Homes Built before 1978
EPA’s rules require sellers and lessors of residential properties built before 1978 to provide prospective buyers and tenants with:

  1. a federal brochure about lead-based paint,
  2. any information known about lead-based paint in the home, and
  3. a warning statement about the potential dangers of lead-based paint.

Agreement Required Companies to Certify Ongoing Compliance
In September, EPA’s Region 9 issued a news release regarding the companies’ agreement.  In addition to the fines, the agreement required the companies to certify they are now in compliance with lead paint disclosure requirements.
